1. Acceptance of Terms

By accessing or using Iconly ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Iconly is an AI-powered icon generation platform that allows users to create custom icons for personal and commercial use. The Service includes icon generation, library management, and CDN delivery features.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account
  • Verify your email address within 24 hours of registration

3.1 Email Verification

All accounts require email verification. Accounts that remain unverified for more than 24 hours may be automatically deleted along with any associated data. This helps us maintain service quality and prevent abuse.

3.2 Registration Restrictions

We reserve the right to block registration from certain email domains to prevent abuse and maintain service integrity. If your email domain is blocked, you may contact us at [email protected] to request access.

4. Acceptable Use Policy

You agree not to use the Service to generate, store, or distribute content that:

  • Is pornographic, sexually explicit, or obscene in nature
  • Promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Is illegal or promotes illegal activities
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Harasses, threatens, or intimidates others
  • Impersonates any person or entity

Violation of this policy will result in immediate account suspension or permanent deletion at our sole discretion, without refund.

5. Payments and Refunds

5.1 Token Packs

Token packs are one-time purchases that add tokens to your account balance. All token pack purchases are final and non-refundable. Tokens do not expire and remain available until used.

5.2 Subscriptions

Subscription plans provide monthly token allocations and additional features. Regarding refunds:

  • Subscriptions are refundable within 24 hours of purchase, provided no tokens from that subscription period have been used
  • After 24 hours or after any token usage, subscriptions are non-refundable for the current billing period
  • You may cancel your subscription at any time to prevent future charges
  • Upon cancellation, you retain access to subscription features until the end of your current billing period

5.3 Refund Requests

To request a refund for an eligible subscription, please contact us at [email protected] within 24 hours of your purchase. Accounts found to have engaged in trial abuse or any other form of account abuse are disqualified from all refunds.

5.4 Free Trials and Trial Abuse

Free trials are limited to one trial per person. Creating multiple accounts to obtain additional free trial tokens constitutes trial abuse. If we determine, at our sole discretion, that you have engaged in trial abuse:

  • Account suspension: All associated accounts will be immediately suspended
  • Charges applied: The payment method on file will be charged for one billing period of the trial plan that was abused, for each account involved in the abuse
  • Any tokens obtained through trial abuse will be forfeited
  • You may be permanently banned from creating future accounts on the Service

By starting a free trial, you authorize Iconly to charge the payment method on file as described above in the event of trial abuse. This charge is non-refundable.

6. Intellectual Property

6.1 Your Content

You retain ownership of the icons you generate using the Service. You are granted a perpetual, worldwide license to use, modify, and distribute icons you create for both personal and commercial purposes.

6.2 Our Service

The Service, including its design, features, and underlying technology, is owned by Iconly and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to:

  • Modify or discontinue features with reasonable notice
  • Perform maintenance that may temporarily affect availability
  • Limit access during periods of high demand

8. Limitation of Liability

To the maximum extent permitted by law, Iconly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to your account
  • Any interruption or cessation of the Service
  • Any content generated through the Service

9. Indemnification

You agree to indemnify and hold harmless Iconly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms of Service
  • Violation of the Acceptable Use Policy
  • Fraudulent or illegal activity
  • Trial abuse, including creating multiple accounts to obtain additional free trial tokens
  • Extended periods of inactivity
  • Failure to verify your email address within 24 hours of registration

Upon termination, your right to use the Service ceases immediately. We may delete your account data, including generated icons, after a reasonable retention period. Unverified accounts may be deleted automatically after 24 hours without additional notice.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of South Dakota.
